CCH and its allies are excited about an Illinois appellate decision holding hospitals accountable for providing "charity care". Charity care is the term used to describe the that obligation tax-exempt hospitals have to provide free and low-cost medical care to people who cannot afford it.
You can read the decision, Provena Covenant Medical Center and Provena Hospitals v. The Department of Revenue of the State of Illinois (4th Dist. August 26, 2008).
Unhappy with the decision, Provena appealed to the Illinois Supreme Court. You can read the Petition for Leave to Appeal filed by Provena and the Answer filed by the Illinois Attorney General.
